This agreement (“Agreement”) is entered into between Grant MMA Gym, located at 6-4884 Dufferin St, North York, ON, M3H 5S8, (“Gym”), and the undersigned member.
**1. Membership Term: **
The membership term shall commence on the Effective Date and shall continue on a month-to-month basis until terminated in accordance with the terms herein.
**2. Membership Benefits: **
As a current member, you will have access to the gym facilities during operating hours: Mondays, Wednesdays and Fridays, from 10:30am – 8:00pm, Tuesdays and Thursdays, from 10:30am – 9:00pm, and Saturdays and Sundays from 10:00am-4:00pm. Operating hours are subject to change at the discretion of the Gym.
**3. Billing and Payment: **
Membership fees will be billed bi-weekly to the payment method provided by the Member upon enrollment. The Member authorizes the Gym to automatically charge the designated payment method for the membership fees. Members with past due membership payments will not be accepted in class.
**4. Cancellation Policy: **
Members can request to cancel their membership with 30-days notice after the first month of regular fees has been processed. Notice must be given in person at the gym, online via email to info@grantmma.ca, or by phone. Cancellation of the membership requires completion of the “Membership Cancellation Form”, which can be found on the Grant MMA Gym website: https://grantmma.ca/membership-cancellation/. The cancellation will take effect 30 days from the date the Gym receives the completed “Membership Cancellation Form”. All payments due throughout the final 30 days will be collected and the member can continue to attend classes
**5. Hold Policy: **
Effective January 6, 2025, there will be a fee of $1/day for account holds.
An upfront charge will be issued that reflects the duration of your hold, for example: 14-day hold = A single charge of $14.00. If you wish to extend your hold, you must notify us in advance of the hold end date via email/phone. Regular bi-weekly payments will resume after your hold end date. If you wish to cancel your membership a 30-day notice is required, as per Section 4 of the agreement.
**6. Termination: **
Grant MMA Gym reserves the right to terminate a membership for violation of Gym rules and regulations, disruptive behavior, non-payment of fees, or any other reason deemed appropriate by the Gym management.
**7. Changes to Terms: **
The Gym reserves the right to modify the terms of this Agreement, including membership fees and benefits, with 30 days’ notice to the Member. Continued use of the Gym facilities following such modifications constitutes acceptance of the revised terms.
**8. Governing Law: **
This Agreement shall be governed by and construed in accordance with the laws of Ontario/Canada. Any disputes arising out of or relating to this Agreement shall be resolved through arbitration in accordance with the rules of the Small Claims Court Ontario. **9. Entire Agreement: **
This Agreement constitutes the entire understanding between the Grant MMA Gym and the Member concerning the subject matter herein and supersedes all prior agreements and understandings, whether written or oral.
